Interview with Steve Bliss, Escondido Probate Attorney

Focusing on Protecting Your Loved Ones

Hello, and thank you for joining me today. I’m speaking with Steve Bliss, a renowned probate attorney here in Escondido. Steve, thanks for taking the time.

Steve, what are some common estate planning concerns that your clients express?

One of the most frequent concerns I hear is about protecting assets for loved ones. People want to ensure their hard-earned money and possessions go to their children, grandchildren, or other beneficiaries without unnecessary complications or delays.

Many people consider a Will to be sufficient for estate planning. Can you explain why a trust might be a better option in some cases?

While a will is important, it goes through probate, which can be a lengthy and public process. A trust, on the other hand, allows assets to pass directly to beneficiaries, avoiding probate altogether.

Consequently, trusts offer several advantages: increased privacy, faster asset distribution, and potential tax savings.

Let’s talk about a specific type of trust – the Special Needs Trust. Can you elaborate on how it works?

A Special Needs Trust (SNT) is designed to provide for individuals with disabilities without jeopardizing their eligibility for government benefits like Supplemental Security Income (SSI) or Medi-Cal.

These trusts can be funded either by the beneficiary themselves (first-party SNT) or by family members or friends (third-party SNT). The trustee manages the funds and distributes them according to the beneficiary’s needs, ensuring they receive necessary support while maintaining their access to crucial benefits.

I’ve worked with numerous families navigating the complexities of caring for a loved one with special needs. Seeing the relief and gratitude when we successfully set up an SNT that safeguards their future is incredibly rewarding.

For instance, I recall helping a family whose daughter had Down syndrome. They were concerned about her long-term care after they were gone. Establishing a third-party SNT allowed them to leave funds specifically for her needs, ensuring she would have ongoing support without losing vital benefits.

According to the National Alliance on Mental Illness (NAMI), approximately 1 in 5 adults in the US experience mental illness each year. Many of these individuals may require ongoing care and support, highlighting the importance of planning for their future well-being.

Have you encountered any unique challenges when setting up Special Needs Trusts?

While SNTs are powerful tools, navigating the legal requirements and eligibility criteria can be complex. It’s crucial to work with an experienced attorney who understands the intricacies of these trusts and can ensure they comply with all applicable regulations.

What advice would you give to someone considering a Special Needs Trust?

My advice is to consult with an estate planning attorney as soon as possible. We can assess your individual circumstances, discuss your goals for your loved one, and determine if an SNT is the right solution for your family.
