“After that, it’s about petitioning the court, notifying interested parties, and undergoing a thorough investigation. Finally, we have a court hearing where everyone gets a chance to voice their concerns.” Ted adds, “And if everything is in order, the judge will appoint the guardian.

Ted, Let’s Dive into The Court Investigation and Evaluation Step – What Happens During That Phase?

“Ah, this is crucial! Imagine the court appoints a sort of detective for the case,” Ted explains. “They’re called a ‘guardian ad litem’, and they have a big job. They interview the proposed ward to understand their wishes and capabilities.

Think of it as getting the individual’s perspective. Then, they check out their living environment, speak with family members, caregivers – even doctors or therapists if needed. This helps paint a complete picture for the court.” Ted leans forward. “The goal is to ensure the proposed ward’s best interests are truly at the heart of every decision.
