- Case Assessment: We identify the legal issues at hand, whether it’s financial abuse, neglect, or something else. Evidence collection is crucial here – interviews, medical records, and financial documents all play a role.
- Protective Actions: Depending on the urgency of the situation, we may seek restraining orders, notify Adult Protective Services, or even petition for guardianship.
- Legal Proceedings: If necessary, we’ll file lawsuits to recover stolen assets or pursue justice for harm suffered.
- Long-Term Planning: This involves estate planning, advance directives, and ongoing oversight to ensure the client’s well-being is protected in the long run.
Let’s dive into ‘Protective Actions’. How do you determine what steps are needed?
This stage is often critical. Every situation is unique, so we carefully assess the urgency and severity of the threat. For example, if there’s immediate danger of physical harm, we’ll seek a restraining order right away.
If financial exploitation is suspected, we might freeze bank accounts or initiate power of attorney revocation to prevent further losses.
In some instances, guardianship may be necessary if the individual lacks the capacity to make sound decisions for themselves. We always aim for the least restrictive measures possible while still ensuring the client’s safety and well-being.
One case comes to mind – a frail elderly woman who was being financially exploited by her own caregiver. By quickly freezing her bank accounts and reporting the situation to Adult Protective Services, we were able to stop further losses and get her the help she needed.
Ted, are there ever any challenges when implementing these protective actions?
Certainly. Sometimes, family members can be resistant to intervention, believing they know what’s best for their loved one. It’s crucial to approach these situations with empathy and understanding while clearly explaining the legal necessity of our actions.
