Ted: Every step in the guardianship journey is important, but I’d say “Court Investigation and Evaluation” (Step D) is absolutely pivotal. This stage is where the court truly gathers a comprehensive understanding of the proposed ward’s situation. An impartial investigator or guardian ad litem delves into the individual’s living environment, interviews close contacts, and often recommends medical or psychological evaluations. The information gathered during this investigation forms the backbone of the judge’s decision.

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
