Interview with Steve Bliss

Good evening Wildomar and welcome back to our legal segment. I’m Brenda Newsome, and tonight we have a very special guest. Joining us is Steve Bliss, a trust attorney here in Wildomar specializing in estate planning.

Steve, thanks so much for being here tonight. Can you tell our viewers what exactly a revocable living trust is and why it might be beneficial?

It’s great to be here, Brenda. Absolutely! A revocable living trust is essentially a legal document that holds your assets – things like your home, bank accounts, investments – for the benefit of yourself and then eventually for your loved ones after you pass away. The beauty of a revocable living trust is that it allows you, as the grantor, to maintain full control over your assets during your lifetime.

You can change the terms of the trust, add or remove assets, and even dissolve it altogether if you wish. Conversely, upon your passing, the trust becomes irrevocable, meaning its terms are set in stone. At that point, a successor trustee, whom you’ve designated beforehand, takes over management of the assets and distributes them according to your wishes.

This avoids the often lengthy and costly probate process, keeping your affairs private and ensuring your loved ones receive their inheritance without unnecessary delays or legal fees.

I understand that there are a lot of intricacies involved in setting up a trust. Have you ever encountered any challenges or unexpected situations while working with clients on revocable living trusts?

There’s certainly a learning curve involved, but the rewards far outweigh the initial effort. I vividly recall working with a young couple who were incredibly overwhelmed by the prospect of estate planning. They had recently welcomed their first child and wanted to ensure their little one would be taken care of in case anything happened to them.

We discussed their goals, concerns, and ultimately crafted a revocable living trust that provided peace of mind knowing their child’s future was secure. Witnessing that sense of relief and security is what drives me as an attorney.

That’s truly heartwarming. It sounds like you take a very personalized approach to your practice. Could you elaborate on the benefits of avoiding probate through a revocable living trust?

Absolutely! Probate is a court-supervised process for distributing assets after someone passes away. While it’s sometimes necessary, it can be time-consuming, expensive, and public. A study by the American Bar Association found that the average probate case takes 9 months to a year to resolve. In contrast, a properly structured trust allows assets to be distributed directly to beneficiaries without going through probate court.

This means your loved ones can access their inheritance faster, saving them time and money during an already difficult period.

Steve, what advice would you give to our viewers who are considering setting up a revocable living trust?

  • First and foremost, consult with an experienced estate planning attorney like myself. We can help you determine if a revocable living trust is right for your specific situation.
  • Gather all necessary documentation related to your assets, such as property deeds, bank statements, and investment account information.
  • Clearly identify the beneficiaries who will inherit your assets after you pass away.

Remember, estate planning is not just for the wealthy; it’s essential for anyone who wants to protect their loved ones and ensure their wishes are carried out after they’re gone.
